Nakawa MP Micheal Kabaziguruka Out On Bail
Nakawa Member of Parliament Michael Kabaziguruka is now a free man.
Kabaziguruka who is battling charges relating to treachery before the General Court Martial has been granted a cash bail by the High Court in Kampala.
Justice Yasin Nyanzi has ordered Kabaziguruka to pay Sh5 million on top of executing a non-cash bond of Sh10 million before regaining his freedom.
The Judge then ordered Kabaziguruka’s 4 sureties including the Lord Mayor Elias Lukwago, FDC party president Gen Mugisha Muntu, FDC spokesperson Ibrahim Ssemujju Nganda and Rubaga North MP Moses Kasibante to also sign a non-cash bond of Sh100 million each to ensure that Kabaziguruka returns to court for trial.
Kabaziguruka has also been barred from travelling out of the country without the High Court’s permission where he is required to report twice in every fortnight starting from 5th/November 2016.
Meanwhile the judge has called on the Law Reform Commission, Parliament and individual members to make amendments to the law so that in the future the DPP does not simply refuse to respond to matters before court.
Jjustice Nyanzi heard Kabaziguruka’s bail application ex-parte as after the DPP refused to respond to it saying the law does not allow him to prosecute matters that are before the General Court Martial.
The judge ruled that since this is not the first time the Director of Public Prosecutions (DPP) is refusing to prosecute matters arising out of the Army Court, he had to borrow a leaf from his learned colleague Justice Masalu Musene who went ahead to release General David Sejusa on bail in the absence of the DPP in February this year.
Just like justice Masalu, Justice Nyanzi said he could not just sit and look on while a litigant was before him seeking justice.
