His political rival Paul Mwiru had filed a petition challenging Nabeta’s victory.

However,  the 3 justices dismissed his appeal on the ground that Mwiru filed his memorandum of appeal out of time.

Paul Mwiru was accusing the Electoral Commission and Nabeta of conniving to rob his victory in the January 2021 election by falsification of results,  thereby affecting the outcome substantially.

High Court Judge Issa Sserunkuma has also dismissed this petition saying, ANT’s  Paul Mwiru failed to convince the court that there was sufficient ground to call for the nullification of Nabeta’s victory.

Being dissatisfied with the decision of the High Court,  Mwiru proceeded to the court of Appeal seeking to overturn the decision.
