Sejusa’s bail in High Court challenged

Uganda People’s Defence Forces legal chief has petitioned the Constitutional Court, challenging former Coordinator of Military Intelligence Gen. David Sejusa’s release on bail, pending hearing of his case at the army court.

On April 1, 2016 Justice Wilson Masalu Musene the head of Criminal Division of the High Court released Sejusa on a non-cash bail of sh10m after presenting two substantial sureties, who were bonded at Sh50m not cash.

Through Kodili and Company Advocates, Brig. Ramathan Kyamulesire is seeking a court declaration that the directive of Justice Margret Oguli-Oumo that Gen.Sejusa applied for bail at High Court yet there was no pending criminal charge against him in that court which was inconsistent with and in contravention of articles 129 and 210 of the Constitution.

Sejusa was charged with the offences of absence without leave, two offences of participating in political activities, insubordinate behavior, and two counts of conduct prejudicial to good order and discipline expected from an army officer.
