Rebel MPs

The Constitutional Court has dismissed an application by the NRM rebel MPs.

The application relates to a petition by the NRM party seeking to temporarily block the four expelled MPS from accessing parliament.

The MPs through their lawyers led by Prof. George Kanyeihamba had opposed the hearing by the three justices saying the court is not fully constituted.

They had also challenged the fact that the Acting Chief Justice is also one of the three justices hearing the case.

However, the judges have dismissed the application on grounds that there is no law that bars them from hearing an application arising out of a constitutional petition.

They say that they are simply hearing not interpreting the constitution and that no law bars the Chief Justice from hearing a case.

Hearing of the temporary injunction has been fixed for July 30th.
