Court Martial slashes Rwakihembo’s sentence

The General Court Martial has reduced the jail term handed to Corporal Herbert Rwakihembo from 30 to 15.

The UPDF soldier was convicted for the murder of three people at Luzira Kisenyi zone in December 2012.

A seven member court chaired by Brig. Moses Ddiba Ssentongo said the 30 years given to Rwakihembo by the Division Court Martial that sat at Luzira Church of Uganda Primary School were hash and excessive given the fact that he was a first time offender and given the circumstances under which the offence was committed.

The court also faulted the Division Court Martial chaired by the late Col. Geoffrey Kakama for having charged and convicted Rwakihembo of attempted murder instead of charging him with causing grievous bodily harm.

The court has thus set a side both the conviction and sentence of 5 years in respect of the attempted murder charge.

However Brig. Ddiba said the court could not set Rwakihembo free since he was a trained soldier who is expected to have self-control when provoked by the 3 deceased civilian women.
