Former Mukono DPC Death Sentence Appeal Quashed
Finally the hearing of an appeal filed by former Mukono DPC James Peter Aurien challenging his conviction and death sentence was kicked off.
The appeal was heard by three justices of Appeal Court; Augustin Nshimye, Remmy Kasule and Justice Rubby Opio Aweri who served their judgement on notice.
ASP Aurien’s lawyer Charles Opwonya has asked Court of Appeal to set a side Aurien’s conviction and sentence from lower court on ground that malice a fore thought was not proved.
In alternative he asked court to reduce the charge from murder to manslaughter because he has no intention to kill his wife Christine Apolot.
The jailed James Peter Aurien was first acquitted before his conviction in April 2009 by the High Court after prosecution had failed to produce witnesses but later the charge were re-instated hence his conviction.
He is said to have shot dead his wife Christine Apolot in 2009 after getting marital misunderstandings
